  • The Arizona Supreme Court has established Ethical Rules that govern the relationship between attorneys and clients, including the determination of attorney's fees (see, ER 1.5).

How are attorney's fees determined in criminal cases?
  • The facts and seriousness or complexity of a criminal case will determine how much the attorney's fees will be. 
  • There is no charge for the initial consultation.
  • Discussing the legal situation will help to understand the complexity of the case and determine what the fee should be.
  • Depending upon the facts of each case, the fee might be charged at an hourly rate or as a flat fee.
Does the attorney's fees include expenses?
  • No. Expenses are in addition to attorney's fees.
  • The client is responsible for expenses related to the litigation.
  • For example, if your case requires the consultation or testimony of an expert witness, the fee for the expert is in addition to any fee paid to the attorney.
